KonnectFrame - Terms and Conditions

1. Introduction

These trading terms and conditions govern the sale and purchase of aluminium components on KonnectFrame (hereinafter referred to as "goods") offered by KonnectFrame (hereinafter referred to as "Seller") to the buyer (hereinafter referred to as "Buyer").

2. Order and Acceptance

2.1. The Buyer may place an order for the goods through the Seller's website.

2.2. The Seller will acknowledge receipt of the order by sending an email to the Buyer.

2.3. The acknowledgement of the order does not constitute acceptance of the order. The Seller reserves the right to refuse to accept any order for any reason.

2.4. The contract between the Buyer and the Seller will only be formed when the Seller dispatches the goods to the Buyer

3. Price and Payment

3.1. The price of the goods shall be as set out on the Seller's website at the time the Buyer places the order.

3.2. The Buyer shall pay for the goods at the time of placing the order.

3.3. Payment shall be made through the Seller's website using a valid credit or debit card.

3.4. All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system.

4. Delivery

4.1. The Seller shall deliver the goods to the address specified by the Buyer in the order.

4.2. Delivery shall be made within a reasonable time after the Seller has accepted the order.

4.3. The Seller shall not be liable for any delay in delivery caused by circumstances beyond its control.

4.4. If the goods are lost or damaged in transit, the Buyer shall notify the Seller within a reasonable time.

5. Returns and Refunds

5.1. If the Buyer is not satisfied with the goods for any reason (except ‘Bespoke’ items as noted in point 5.10), the Buyer may return the goods to the Seller within 14 days of receipt of the goods.

5.2. The Buyer shall be responsible for the cost of returning the goods to the Seller.

5.3. The Seller shall refund the purchase price of the goods to the Buyer within 14 days of receipt of the returned goods.

5.4. The Seller reserves the right to refuse a refund if the goods are not returned in their original condition.

5.5. The Seller reserves the right to inspect all returned goods to ensure they are in their original condition and fit for resale.

5.6. The Seller will notify the Buyer within a reasonable time if the returned goods are not in their original condition and fit for resale.

5.7. If the returned goods are not in their original condition and fit for resale, the Seller reserves the right to refuse a refund or charge a restocking fee.

5.8. The Buyer shall cooperate with the Seller in the inspection process, including providing any information or documentation requested by the Seller.

5.9. The provisions of this clause shall apply to all returns, regardless of the reason for the return.

5.10 The Buyer accepts that for any ‘Bespoke’ items, no return or refund can be offered unless damaged or faulty.

6. Liability

6.1. The Seller shall not be liable for any loss or damage caused by the goods except to the extent that such loss or damage is caused by the negligence or wilful misconduct of the Seller.

6.2. The Seller's liability for any claim in respect of the goods shall be limited to the purchase price of the goods.

6.3. The Seller shall not be liable for any indirect or consequential loss or damage, including but not limited to loss of profits, loss of business, or loss of goodwill.

7. Governing Law and Jurisdiction

7.1. These trading terms and conditions shall be governed by and construed in accordance with the laws of the United Kingdom (UK).

7.2. Any dispute arising out of or in connection with these trading terms and conditions shall be subject to the exclusive jurisdiction of the courts of the United Kingdom (UK).

8. Entire Agreement

8.1. These trading terms and conditions constitute the entire agreement between the Buyer and the Seller and supersede all prior agreements.

 

9. Intellectual Property

9.1. The Buyer acknowledges that all intellectual property rights in the goods, including but not limited to any patents, trademarks, copyrights, and trade secrets, belong to the Seller.

9.2. The Buyer shall not copy, reproduce, modify, distribute, or use the goods or any part thereof except as expressly authorised by the Seller.

9.3. The Buyer shall not use any of the Seller's intellectual property rights, including the Seller's trademarks, logos, or trade names, without the Seller's prior written consent.

9.4. The Buyer shall notify the Seller immediately if it becomes aware of any unauthorised use of the Seller's intellectual property rights.

9.5. The Seller reserves the right to take legal action against any person or entity that infringes upon its intellectual property rights.

9.6. The provisions of this clause shall survive termination or expiry of this agreement.
